1. Acceptance of Terms
By creating an account or using Nexivo's website, dashboard, or voice/call features (together, the "Service"), you agree to these Terms & Conditions. If you're using the Service on behalf of a business, you're agreeing on that business's behalf and confirming you have the authority to do so.
2. Description of Service
Nexivo provides an AI receptionist and executive assistant that can answer calls, place calls, book and manage appointments, and integrate with calendars, CRMs, and booking systems you choose to connect.
3. Accounts
You're responsible for maintaining the security of your account and for all activity that happens under it. You agree to provide accurate information and to keep it up to date.
4. Subscriptions & Billing
Paid plans are billed on a recurring basis (monthly or annually, as selected) per the pricing shown at checkout or on our
Pricing page. You can cancel at any time; unless stated otherwise for your plan, fees already paid are non-refundable except where required by law.
5. Acceptable Use
You agree not to use Nexivo to:
- Make unsolicited, unlawful, or fraudulent calls or messages, including in violation of telemarketing or robocall laws.
- Record calls without obtaining any consent required by applicable law.
- Harass, deceive, or impersonate any person or business.
- Attempt to reverse-engineer, disrupt, or gain unauthorized access to the Service.
- Violate any applicable law or the rights of others.
6. Your Responsibilities
You're responsible for complying with call-recording, telemarketing, and data-protection laws that apply to your business and the calls Nexivo handles on your behalf, including obtaining any consent from your own customers or callers that the law requires.
7. Third-Party Integrations
If you connect a third-party calendar, CRM, or other tool, that provider's own terms and privacy policy also apply to your use of it. We aren't responsible for third-party services we don't control.
8. Intellectual Property
Nexivo and its content, features, and underlying technology are owned by Nexivo, Inc. and protected by intellectual property laws. You retain ownership of the data you submit to the Service.
9. Disclaimers
The Service is provided "as is." While we work hard to make Nexivo reliable and accurate, we don't guarantee that it will be error-free, uninterrupted, or that it will always correctly understand or act on every call.
10. Limitation of Liability
To the maximum extent permitted by law, Nexivo will not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that creates risk or legal exposure for us or others.
12. Governing Law
These Terms are governed by the laws applicable in the jurisdiction where Nexivo, Inc. is incorporated, without regard to conflict-of-law principles.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the updated Terms.
